Cognite Hub and Academy Terms & Conditions

Cognite Hub and Cognite Academy are provided by Cognite AS (“Cognite”) as a place for discussion and education on everything related to your Cognite products and services. The following terms and conditions for the use of Cognite Hub and Cognite Academy (the “Terms & Conditions”) are presented here. By clicking consent, you acknowledge and accept these terms and conditions. Cognite reserves the right to change these terms and conditions at its sole discretion. The terms and conditions apply to your visits and use of the above services. The content on Cognite Hub and Academy is primarily in English. Cognite Academy has a Japanese learning path that is available to Japanese customers.

Cognite Hub

General guidelines

For everyone's benefit, please stay on-topic. Please refrain from discussing personal matters, abusing any company or product, or from posting in a manner unrelated to Cognite’s products and services. Cognite Hub is a public community, except for its private groups, so do not post any information that you do not wish to make public. Any information that you post can be obtained and used by others -you post at your own responsibility. Stay courteous. Everyone wants to have a positive experience on Cognite Hub - so make sure that you are not detracting from anyone else's experience. Your opinions are always welcome, but personal attacks and harassment on Cognite Hub is not acceptable. Keep it spam-free. Cognite Hub is a professional community, not intended for the promotion of third party services, products, websites, or organizations. Please refrain from posting content that would constitute advertising, junk mail, spam, chain letters, or any other form of unauthorized solicitation. Keep it legal. It is unacceptable to post any material (i) that would infringe on any patent, trademark, copyright, or other proprietary rights of any party or disclose any trade secret (or other confidential information), (ii) that contains software viruses or any other computer code or files that are designed to disrupt, damage, or limit the functioning of any software or hardware, or (iii) that is deemed to be illegal by any local, state, federal, or international law. Cognite does not edit, monitor or pre-screen content posted by users on Cognite Hub. However, Cognite retains the right, at its sole discretion, to limit any users' access to Cognite Hub and to remove content or material that, in Cognites' sole judgment, does not comply with these Terms & Conditions, or that is otherwise inappropriate, harmful, objectionable, or inaccurate. Cognite may take any action it deems necessary in their own judgment to support the Terms & Conditions and to ensure that content on Cognite Hub does not violate applicable laws. Such actions may include editing or deleting material and temporary or permanent banning of individual users. Cognite Hub is supervised by a number of moderators who ensure that members follow Cognite’s Terms & Conditions. If you are new to Cognite Hub and are unsure about anything, just ask! The Cognite moderators and other users are happy to help. You can always report violations through the ‘Report Inappropriate Content’ feature or contact the Cognite Community moderators at: hub@cognite.com.

User Account

When setting up your account, you agree to provide true, accurate and complete information about yourself. For any question related to your user account, please contact us at hub@cognite.com. Cognite reserves the right to refuse to grant you membership or revoke your existing membership, if we have reasonable suspicion that you are impersonating someone else. We may also refuse to grant you membership or revoke your existing membership if we have reasonable suspicion that your activities are illegal or in breach of these Terms & Conditions. You are responsible for maintaining the confidentiality of your password, and are responsible for all activities (whether by you or by others) that occur under your password or your user account. You may not use a third party’s user account, user name or password at any time, and you will not allow anyone to access or use Cognite Hub from your user account. You agree to notify Cognite immediately of any unauthorized use of your account, user name or password. Cognite shall not be liable for any losses you incur as a result of someone else’s use of your account or password, either with or without your knowledge. You may be held liable for any losses incurred by Cognite, our affiliates, officers, directors, employees, consultants, agents and representatives due to someone else’s use of your account or password. You will promptly notify Cognite of any suspected violation of these Terms & Conditions and will cooperate with Cognite to address the suspected violation.

Privacy & Confidentiality

You must register to use Cognite Hub. You should only register one account. Cognite’s Privacy Policy contains guidelines on how Cognite collects, uses and protects personal information. You have the ability to remain anonymous by choosing a username that does not identify you. If you are a Cognite customer, you must ensure that your registration and contribution to Cognite Hub are not in breach of any company policy or confidentiality obligation.

Private messages and moderator actions

Moderator actions and the contents of private exchanges with moderators, staff members and administrators should not be shared or discussed on the public forums. Such material will be removed by moderators. If you have questions or comments regarding moderator actions, contact the forum moderators through private message or by sending an email to Hub@cognite.com.

Limited License

Cognite hereby authorizes you to copy materials published by Cognite on this website solely for non-commercial use within your organization in support of Cognites products. No other use of the information is authorized. In consideration of this authorization, you agree that any copy of these materials which you make shall retain all copyright and other proprietary notices in the same form and manner as on the original. Except as specified above, nothing contained herein shall be construed as conferring by implication, or otherwise any license or right under any patent, trademark, copyright or any other intellectual property right of Cognite or any third party. Users are not permitted to modify, distribute, publish, transmit or create derivative works of any material found on the site for any public or commercial purposes. Content included on this site and provided by or on behalf of Cognite (including but not limited to text, graphics, logos, images and forum posts) is the exclusive property of Cognite.

Access to By Invitation Only/Secure Areas

You may request to access private groups on the Hub by clicking on “request to join". Unauthorized access to private groups is a breach of these Terms & Conditions.

Links to Third Party Sites

Cognite Hub may contain links to third party sites. Access to any other internet site linked on this website is at the user's own risk and Cognite is not responsible for the accuracy or reliability of any information, data, opinions, advice or statements made on these sites. Cognite provides these links merely as a convenience and the inclusion of such links does not imply an endorsement. Any links posted by you are subject to all terms and conditions like any other type of content posted on Cognite Hub. You may not post a link that directs users to any content or information that would constitute a violation of these Terms & Conditions.

Cognite Academy

General guidelines

Cognite Academy helps customers and partners increase their autonomy by developing Cognite Data Fusion (CDF) skills and upskilling on digital skills. In order to use Cognite Academy, you must create an account. Your Cognite Hub account is linked to your Cognite Academy account, this means that you can access both the Hub and Academy once you have been granted membership. When setting up your account, you agree to provide true, accurate and complete information about yourself. Your registered personal details will be the personal details that show up on your certificate when you complete a course. We reserve the right to refuse to grant you membership or revoke your existing membership, if we have reasonable suspicion that you are impersonating someone else. We may also refuse to grant you membership or revoke your existing membership if we have reasonable suspicion that your activities are illegal or in breach of these Terms & Conditions.

Certificate

After completing certain courses and earning a passing grade in the assessment, you are granted a certificate of completion and/or a badge on your Cognite Hub profile. These certificates are issued by Cognite Academy and can be shared on LinkedIn and downloaded as PDF.

Cognite Academy is not connected to an official accreditation body.

Cognite Data Fusion (CDF) Projects

If you are using CDF projects as part of a Cognite Academy course, you should also read our Master Subscription Agreement that applies to customers' use of CDF and Cognite Applications. Cognite Academy is not a sandbox environment, you should only use CDF projects to follow the course instructions. Do not interact with data that has been created or is being used by other learners. We will clean up the project and remove the training data on a regular basis. The deadlines for you to finish all work before the next scheduled cleanup is always communicated in the course. Using the Academy environment for any other purposes than learning is a breach of these Terms & Conditions. Furthermore, we cannot guarantee that any data or activity that is not connected to the course activity will remain in the project.

Privacy & Confidentiality

Cognite Academy will process your personal data according to our Privacy Policy. You are responsible for the confidentiality of your own username and password and never share this information with any third party. If you are a Cognite customer or partner, we may share information related to your course progression, your grade and if you have completed any of our modules with your employer. Cognite Academy acts as a Data Processor when we share this information. Please contact your relevant Company representative if you would like to opt-out or have any questions related to the information we share as a Data Processor. Any data created or ingested by you during the course is visible to all other members of Cognite Academy. Please consult with your Company representative before uploading any data as part of your data training of CDF.

Limited License

Through your membership, Cognite Academy grants you a limited non-commercial license to use the site to Academy, download material, features and certificates. All material, including text, video content, documentation, graphics and designs is protected under copyright and owned by Cognite. Nothing in these Terms & Conditions shall be construed as conferring any transfer of Cognite’s intellectual property rights (IPR).

Trademarks

The trademarks, logos and service marks ("Marks") displayed within Cognite Academy and Cognite Hub are the property of Cognite or other third parties. Users are not permitted to use these Marks without the prior written consent of Cognite or such third party which may own the Mark. "Cognite" and all Cognite product names are trademarks of Cognite.

Disclaimer and limitation of liability

You acknowledge that you are using Cognite Hub & Academy at your sole risk. To the fullest extent allowed by applicable law, Cognite Hub & Academy is provided on an “as is,” “with all faults,” and “as available” basis without warranty of any kind, whether express, implied, statutory, or otherwise including but not limited to those of merchantability, fitness for a particular purpose, title, accuracy, completeness, reliability, non-infringement, or any other warranty, condition, guarantee or representation, whether oral, in writing or in electronic form. Cognite does not warrant that access to or use of Cognite Hub & Academy will function without interruption, will meet your requirements, is free of malicious code or that it is free of errors or omissions, or loss or security breach of transmitted information, or that no viruses will be transmitted through access to or use of Cognite Hub & Academy. You are advised to safeguard your data, to use caution and not to rely in any way on the correct functioning or performance of Cognite Hub & Academy and/or accompanying materials. To the maximum extent permitted by law, Cognite and its affiliates shall not be liable towards the users of Cognite Hub & Academy or any third party for any damages, whether direct or indirect, under or in connection with the access to or use of Cognite Hub & Academy, whether in tort, contract, or otherwise. Any liability not efficiently disclaimed by the foregoing, shall be limited to a maximum amount of NOK 100,000.

Governing law and legal venue

These Terms & Conditions and any dispute of any sort that might arise between you and Cognite shall be exclusively governed by and construed in accordance with Norwegian law, without giving effect to any choice or conflict of law provisions of any jurisdiction. Any claim or dispute between you and Cognite that arises out of or is related to Cognite Hub & Academy or these Terms & Conditions, and is not subject to arbitration, shall be decided exclusively by Norwegian courts with Oslo City Court as the agreed legal venue.
